These Terms of Service (“Terms”) govern your use of californiaautohaus.com (the “Website”), operated by California Autohaus, Inc. (“California Autohaus,” “we,” “us,” or “our”), an independent European auto repair shop at 386 Encinitas Blvd, Encinitas, CA 92024. By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. Using the Website

You may use the Website to learn about our services, contact us, and request or book appointments. You agree not to:

  • use the Website in a way that violates any law or regulation;
  • impersonate anyone or misrepresent your identity or affiliation;
  • send spam or unsolicited advertising through the Website’s forms or tools;
  • attempt to gain unauthorized access to the Website, its servers, or any connected systems, or interfere with its normal operation (including through malware or denial-of-service attacks);
  • use bots, scrapers, or other automated means to copy or collect content from the Website without our written permission.

2. Appointments, estimates, and repair work

  • Booking requests. Appointments requested online or by phone are subject to availability and confirmation. Our online booking tool is provided by a third party (see our Privacy Policy).
  • Prices and estimates. Prices, specials, and descriptions on the Website are general information and may change without notice. They are not a quote for your vehicle. Final pricing depends on your vehicle’s condition and the parts and labor required.
  • Written estimate and authorization. As required by California law, repair work is performed only under a written estimate and with your authorization, provided at our shop. The terms of your written estimate, repair order, and invoice (including any warranty we provide) govern the repair work itself. They take precedence over anything on the Website.
  • Specials and promotions. Offers shown on the Website may have conditions, exclusions, or expiration dates. Unless stated otherwise, offers cannot be combined and have no cash value.

3. Accuracy of information

We work to keep the Website accurate and current, but it may contain errors, omissions, or outdated information, including pricing. We may correct errors and update content at any time.

4. Trademarks and content

The Website’s content, including text, graphics, logos, and photos, belongs to California Autohaus or its licensors and is protected by intellectual property laws. You may view and print pages for personal, non-commercial use. Any other use requires our written permission.

Vehicle manufacturer names and marks such as BMW, Mercedes-Benz, Audi, Volkswagen, Porsche, Land Rover, Jaguar, MINI, and Volvo belong to their respective owners. They are used only to identify the vehicles we service. California Autohaus is an independent repair shop and is not affiliated with, authorized by, or endorsed by any vehicle manufacturer.

Copyright concerns. If you believe content on the Website infringes your copyright, email service@caautohaus.com with:

  • a description of the work and where it appears on the Website;
  • your contact information;
  • a statement that you believe in good faith the use is not authorized;
  • your physical or electronic signature.

5. Third-party links and tools

The Website may link to or include third-party websites and tools, such as review sites, maps, financing providers, and our online booking tool. We do not control them and are not responsible for their content, availability, or privacy practices. Your use of them is subject to their own terms.

7. Disclaimer of warranties

THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. This section applies to the Website only. It does not limit any warranty we provide in writing for repair work.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CALIFORNIA AUTOHAUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ITS CONTENT. Nothing in these Terms limits any rights you have under California law that cannot be waived, or our obligations for repair work performed under a written estimate and invoice.

9. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Website or these Terms will be resolved in the state or federal courts located in San Diego County, California. To the extent permitted by law, you and California Autohaus agree to bring claims only in an individual capacity, not as a plaintiff or class member in a class or representative action.

10. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us about the Website.

11. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Website after changes means you accept the updated Terms.
